“He’s just as blameworthy as the photographer, the rapist or the distributor of the photograph,” Bayly said. “He is the market.” Defence lawyer Jeremy Kostiuk requested a sentence of six to nine months to fit with the “quasi criminal” customs charge Emmerling was being sentenced for. He has no related record and only a minor prior conviction from 1994.

“It’s about denunciation and deterrence of bringing the material across the border, period,” Kostiuk said.
